Appeals court: No one should be afraid of 

criticising government

PETALING JAYA: The public should not be afraid to talk about government and public officers’ conduct, says the Court of Appeal.
In a 31-page written judgment by Court of Appeal Judge Justice Idrus Harun, in the case of Pahang Menteri Besar Adnan Yaacob suing Utusan Melayu for defamation, he noted the people should discuss their government and public officials’ conduct without being subjected to civil actions for their opinion.
Image result for dato adnan yaakob“We consider that as one of the fundamental principles, that in the exercise of the right to such freedom within the ambit of the Federal Constitution and related laws, the people should have the right to discuss their government and the officials in carrying out their duties.
“Such right to talk has been enshrined under Article 10(1)(a) of the Constitution, without any common law principle being applied.”
Idrus also said that any actions taken against individuals who voiced out their criticisms was against the public interest and would affect the fundamental liberties of a person.
“As public interest dictates, a democratically elected government and officers should be subjected to criticism and every responsible citizen should not be restrained in their opinions on the government’s affairs and administration.”
The panel, which also consisted of Justice Rohana Yusof and Justice Mary Lim, suggested that the Derbyshire principle, which rules that those holding office in public bodies like local authorities cannot sue in their official capacity, should be applied and be adopted in the country’s defamation laws.
“The English court’s decision, in our opinion, is no less valid and should be applied and be part of our defamation laws.
“It has a similar principle related to our freedom of speech under the Constitution and that public interest does not favour the right of government and its officers to sue for libel,” Idrus said.
It is refreshing to see some judges are still upholding the law and liberty in this country. Sad that the same can’t be said about their fraternity brother in the AG chambers.

  1. "their fraternity brother in the AG chambers"? He was once a Judge, wasn't he? Retired, given the post of AG, his first task appeared to be expressing gratitude beyond expectations - declared the bossman did not do anything wrong over the billions of Ringgit in his bank accounts.

    Not much more can be heard of the 1MDB wrong doings in the country. But hope the investigations in the 7 countries will lead to an explosive scandal many times the present scale leading to the bossman resigning or replaced by UMNO.

    1. Komen aku di 4:05 yang di tujukan kpd komen 2:43 mungkin salah orang yang di tujukan. Sebab 2:43 tak kasi bayangan jika dia bukan Penyokong Najib atau tidak. Kalau salah orang, mintak maaf le teman di pagi hari puasa ni.

      Tapi komen itu memang tepat di tujukan kapada 3:31 di atas ini. Dia memang Mr Fly Kite sebab dia ada tulis begitu. Apa yang aku tulis di 4:05 itu memang tepat untuk dia di 3:31 ini.

    2. U-turn SD emerges over allegation of fraud in Citizens’ Declaration

      The programmer who alleged fraud in the Citizens’ Declaration petition in a statutory declaration (SD) has purportedly made another SD retracting the claim.

      According to the SD which carried Azharuddin Othman @ Abdullah’s name, he claimed that the first SD revealed to the press on May 26 contained “mistakes”.

      In the original SD, Azharuddin alleged that he sold a database of 900,000 names to Syarul Ema Rena Abu Samah, whose nickname is Ratu Naga, for the purpose of the Citizens’ Declaration.

      “I would like to state that I do not know the person known as Ema or also known as ‘Ratu Naga’ and never had any dealings with her.

      “Before this, I was hired to hold a press conference based on the text given by the person who hired me which is Badrul Hisham Shaharin,” he said in the latest SD.

      Azharuddin, 30, who alleged he was offered RM5,000 by an individual called “Ema” on Facebook to provide names from a voter database, only offered a smirk to the challenge.

      Syarul Ema said she had nothing to do with the Citizens Declaration and did not even know Azharuddin.

      “If you look at my Facebook, I am not involved in the Citizens Declaration,” she said.

      Syarul Ema also challenged Azharuddin to show the media his phone to prove that they had contact with each other.

      Azharuddin, in an earlier statutory declaration, claimed he sold 1.2 million signatures for RM5,000 but said he only received RM1,000.

      Ironically, Azharuddin was at the press conference organised by Solidariti Anak Muda Malaysia to deny making a U-turn on his initial claims after a second statutory declaration (SD) purportedly bearing his name surfaced online.

      Badrul Hisham, better know as Chegubard, along with Azharuddin left the venue after Syarul Ema continued to bombard them with questions.

    The key word is "responsible". Most of us are. We give opinions with good intentions, mindful of the laws.

    But often, it's a matter of interpretation of the laws. For example, so many things can be deemed seditious. Anything hurtful to another community, nay, to another individual, can be seditious.

    The one with the power to investigate, more so, the power to decide to prosecute has the best position in respect of those matters.

    The Police have by and large been judicious. The Attorney General, after the sudden removal of Gani Pattail and replacement by Affandi, has come under heavy criticisms, particularly when he declared that Najib has done nothing wrong regarding the RM2.6 billion (later said to be RM4.2 billion) in his bank accounts.

    Well, we "should not be restrained in (our) opinions on the government’s affairs and administration.” Let's keep giving opinions, folks. It's called democracy. It's helping to check the affairs of leaders of the country. In particular, the Prime Minister.

    1. Lepas buat tu semua, hantarkan bukti rasuah tu ke pejabat SPRM. SPRM akan buat syor kpd Peguam Negara. Pandi ambik tindakan ke tidak belakang kira. Biar bertimbun syor2 SPRM di pejabat Peguam negara. Satu masa nanti, mana tau Pandi tak di situ lagi, Peguam Negara baru akan ambik tindakan.

    One recently retired Appeals Court Judge said that his promotion to the Federal Court was blocked by Najib. Wow, that's the way Najib uses to get better chances of court judgments be in his favour?

    "Sad that the same can’t be said about their fraternity brother in the AG chambers." What to say of the "brother" who was appointed by Najib immediately after Gani Pattail was suddenly dismissed from office without notice, valid reason or justification?
